According to reports from the Daviess County Sheriff’s Department, Garner was driving west on US 60 in the early hours of September 3, 2017 when his vehicle left the road and overturned in a lake. Glover, who was a passenger, drowned. Daviess Circuit Judge Jay Wethington turned down a defense motion for the release of funds released in 2017 to release Robert K. Garner, 22, from prison. Glover, 21.
Garner’s bond was originally set at $ 100,000 in full, and Garner was released from prison in December 2017. Half of the $ 100,000 was previously returned to the family member who deposited the bond. The final request required that the remaining $ 50,000 be released.
The Daviess County Sheriff’s assistant division chief investigating the incident previously said a blood test showed Garner was intoxicated beyond the legal limit and that the test showed PCP and opiates in Garner’s system.
The application said the family member wanted the money back and that the family didn’t expect the case to last that long. The case was previously postponed due to the COVID-19 pandemic and at the request of the parties.
Assistant Commonweath’s attorney Mike Van Meter opposed the return of the body money.
The $ 50,000 “guarantee (Garner’s) appearances in court,” Van Meter said.

Rufus Miller, Glover’s grandfather, was called in to testify against the return of the loan money.
“Today 1,541 days have passed since my grandson’s life was taken. On that day, 1,541 days ago, I and my family were sentenced to life imprisonment of grief and sorrow, no bond, no parole, a life sentence until our death. We’re only weeks from the trial. Hopefully then (the case) will be resolved. There is no reason to release this loan money. “
Garner, who appeared on video with his attorney, did not speak during the hearing. Wethington denied the defense.
The trial is scheduled for February 7th.
