BRIAN Laundrie took Gabby Petito’s debit card and spent $ 1,000 to return to Florida without her on September 1, a Petito family lawyer claimed Tuesday.

The FBI issued an arrest warrant for Brian on Aug. 30 for illegally using a card and pin that did not belong to him but did not disclose who the card belonged to.

The Petito family lawyer appeared at an appearance on Dr. Phil confirming that the card was Gabby’s.

“I’m sure the FBI has a lot more evidence than we do. You could see his state of mind by his actions, “said attorney Richard Stafford.

“He was running. He stole your balance [debit per warrent] Map. He used her credit card to get home and then ran away from the police. That will show what he thought. “

The warrant was issued by the Wyoming District Court on September 24th after Brian was charged with “unauthorized device use” by a grand jury.

Court documents indicated that the grand jury charged Brian “knowingly with fraudulent intent” in using a Capital One debit card for at least $ 1,000.

The transactions reportedly took place on August 30th and September 1st.

The Denver FBI believe Gabby was killed between August 27 and August 30.

She was last seen on August 27 when Brian allegedly had an argument with a waitress.

The warrant allows the FBI to keep searching for Brian while they work to find out what happened to Gabby.

The Laundrie family lawyer said in a statement when the warrant was issued that it focused on “activities that took place after Gabby Petito’s death and were unrelated to her actual death”.

“The FBI is focused on tracking down Brian and when that happens the details of the charges will be dealt with on the appropriate forum,” he added.

Gabby’s body was found on September 19, two days after Brian was reported missing by his parents.

They originally said he set out on a hike in the Carlton Reservation on September 14, and they took his car back to their home two days later when he didn’t return.

However, on Tuesday it was found that he left the family home on September 15 instead.

This is in line with witness reports that the Mustang was parked in front of the house that day.

GABBY’S FAVORITE PULLOVER

On Tuesday, Gabby’s family also confirmed that their remains were identified by their stepfather, Jim Schmidt, after FBI agents described they discovered an item of clothing believed to be her favorite sweater.

Then he delivered the message to his wife and Gabby’s father and stepmother.

Gabby’s family refused to comment on who they believed was responsible for her death, but spoke of their heartbreak when her body was found.

Jim Schmidt was in Wyoming when the FBI found what was believed to be Gabby.

He described the moment when FBI agents told him that they had found a body and that there was an identifying piece of clothing.

Jim confirmed Gabby had a sweater like the one found and called the rest of the family while they waited for an official autopsy.

“We knew it was Gabby, although we had hoped it wasn’t,” said mother Nichole Schmidt and burst into tears.

“It was the hardest thing I ever had to listen to. It didn’t hit me right away, but I knew she was gone.

Parents’ grief

“I didn’t want to admit it, but felt it the night I found out the van was in Florida,” she admitted, adding that when she first reported Gabby missing on Saturday, she believed That the couple could both be gone.

However, she learned that the van was back at the Laundrie family’s home in North Port that night when police went to the house.

“It had to get there somehow,” she said. “It’s annoying.”

“I didn’t want to believe it,” added her stepmother Tara Petito when the body was found on September 19.

“My body went into shock and then you collapse, you just fall and cry.

“It’s awful, awful, awful.”

The family says they now believe Brian is still alive when they beat his family up for not talking about what they know.

“I do this because he’s a coward,” Father Joe Petito said when asked if he thought Brian was on the run.

“Everyone who has lived in this house is a coward and cannot stand up for what they do.”
